3.1 S106 and Highways Agreement funding

Section 106 Agreements (S106), where they are still secured, or more commonly, funding through CIL payments can provide funding to improve infrastructure. In the case of S106 these must be spent at a specific location relevant to the source funding, whereas with the increasing provision of funding through CIL, there is greater flexibility within a wider community as to where these monies are spent.

Section 38 and Section 278 Agreements are to provide the improvements/infrastructure in kind, so do not directly involve payments. They do, however, provide prime opportunities for well-designed improvements to the public highway.
